Standard Terms and Conditions of Business
1. All prices include the legal added value tax (VAT) valid at the time of purchase. Payment is due immediately on receipt of invoice, net.
2. Goods with a value of more than € 400 will be delivered door-to-door free of charge in Germay. (Provided that they are delivered by the German Parcel Service (Deutscher Paketdienst)
3. For all orders under the door-to-door limit of € 400, the shipping charges are € 6.5o per parcel (in Germany).
4. If you require assistance to put the cartons into the intended storage room, please let me know in advance.
5. Please make sure that someone is available to accept the shipment during the day on the agreed delivery day. If the carrier has to make a second journey, we will be obliged to charge the costs to your account.
6. Transport risks are borne by Axel Buess EXQUISITE WINES. Please check the goods immediately on delivery. Notification of any complaints should be sent to Axel Buess EXQUISITE WINES immediately so that I can arrange for replacements through my transport insurance.
7. For wines under € 15.00, if the wine ordered is out of stock, the wines of the following years will be delivered.
8. Until they have been completely paid for, the goods remain under extended reservation of ownership.
9. The current online prices found on www.exquisiteweine.de replace all earlier prices. This also means that earlier printed price lists are no longer valid.
10. Our offer is subject to prior sale.
11. Place of performance and jurisdiction is Esslingen, BW, Germany.
12. No compensation can be given for corked wine as this is an unavoidable risk in the wine branch for which producers do not accept liability.
13. Power of Cancellation and Consequences of Cancellation
13.1. You may cancel your declaration to purchase in writing within two weeks without giving a reason (e.g. letter, fax, or e-mail) or by returning the goods unless you acted within the bounds of your trade or activity as a self-employed person. The fixed time limit allowed begins at the earliest on receipt of the goods and detailed written instructions about the cancellation. To comply with the time limit it is sufficient to send in the notice of cancellation or the goods in due time. The notice of cancellation is to be addressed to:

(*) Delete as appropriate.
As the customer placing the order, you have to pay the costs of returning the goods if the goods delivered correspond to those ordered and if the price of the goods to be sent back does not exceed the sum of € 40.
13.2. In the case of the cancellation being effective, the payment/goods received by both parties are to be refunded / returned and, if applicable, any profits drawn (e.g. interest) paid back. If the goods received can only be returned in a totally or partially worsened condition, should it be applicable, you may have to pay us compensation. This is not applicable if the deterioration of the goods derives solely from a test such as would have been available to you if the goods had been bought in a shop. Incidentally, you can avoid the obligation to give compensation by not using the goods as if they were your property and by refraining from doing anything which could reduce their value. Goods which can be returned by parcel post are to be returned at our risk, goods which cannot be returned by parcel post will be collected from you.
13.3. Should returning any goods cause the remainder of the order to fall below any rebates or limits for sending goods free of charge, then the sum involved will be invoiced.
13.4. The power of cancellation is not in force for goods named in § 312d Abs. 4 BGB. I am looking forward to doing business with you on mutually agreeable terms.
14. By bank transfer from outside the European Union we charge an additional fee of 10 Euro excl. VAT.
